| Abstract | This paper discusses about the concept of Double Jeopardy. The paper is divided into three main parts. The first part of the paper discusses about the clauses mentioned in section 300 of the code of criminal procedure. The second part of the paper describes the difference between section 403 of the code of criminal procedure and article 20(2) of the Indian Constitution. Thirdly, it talks about the exception which may be applicable in various instances followed by the conclusion. |
