Abstract | The integration of Artificial Intelligence (AI) into arbitration presents a transformative opportunity to address systemic challenges in India’s arbitration ecosystem, such as delays, high costs, and limited accessibility. This paper examines the role of AI in revolutionizing arbitration practices, focusing on applications such as document management, predictive analytics, virtual arbitration platforms, and bias detection. By leveraging AI tools like natural language processing (NLP) and machine learning (ML), India can streamline arbitration processes, enhance decision-making consistency, and improve transparency. However, the adoption of AI raises critical legal, ethical, and practical concerns, including data privacy risks, algorithmic transparency, and resistance from legal professionals. Through a qualitative analysis of global trends, India’s legal framework, and case studies, this paper evaluates the country’s readiness for AI-driven arbitration. Key findings suggest that while India’s existing infrastructure and government initiatives like Digital India provide a foundation for innovation, challenges such as regulatory gaps, capacity-building needs, and cultural resistance must be addressed. Recommendations include policy reforms to ensure ethical AI use, collaboration between arbitral institutions and technology providers, and training programs for stakeholders. By embracing AI responsibly, India can position itself as a global hub for efficient and inclusive arbitration, fostering trust in its dispute resolution mechanisms and attracting international disputes. This study contributes to the discourse on AI’s role in legal systems, offering actionable insights for policymakers, arbitrators, and legal professionals navigating the intersection of technology and justice. |
