Revising the Prison Manuals to realize Reformation in the Correctional Institutions

Abstract The Criminal Justice System in India, comprising the Judiciary, Police, and Correctional Services, plays a pivotal role in preventing crime, ensuring justice, and rehabilitating offenders. However, a significant proportion of individuals processed through this system belong to socially and economically marginalized communities. The National Crime Records Bureau (NCRB) data from 2019 indicates that a large number of prisoners have limited or no formal education and hail from disadvantaged caste groups. Custodial deaths, particularly suicides, remain a pressing concern, with suicide being the leading cause of unnatural deaths in prisons. Contributing factors include overcrowding, lack of psychological support, isolation from family, and the stigmatization associated with incarceration. Family relationships play a crucial role in the mental well-being and rehabilitation of inmates, yet limited access to communication facilities in Indian prisons exacerbates their sense of hopelessness. Despite existing provisions in the Model Prison Manual and state-specific prison regulations, challenges persist in ensuring prisoners’ rights and well-being. This study examines the existing prison facilities, policies, and legal frameworks with a focus on prisoner rehabilitation and family integration. The research underscores the necessity of revising outdated prison laws, implementing uniform correctional policies, and fostering public participation in prison reforms to create a rehabilitative and humane correctional system.
