Abstract | In the twenty-first century, terrorism has emerged as one of the most significant threats to international peace and security. The events of 9/11 in the United States, the 2005 London bombings, and numerous attacks in India have fundamentally altered the global legal and political landscape. Governments have been compelled to enact robust counterterrorism frameworks to prevent, detect, and respond to terrorist threats. However, these frameworks often tread a delicate line between ensuring national security and preserving the fundamental rights and freedoms of individuals. This research paper explores this complex interplay between counterterrorism measures and human rights protections by conducting a comparative legal analysis of three democracies—India, the United Kingdom, and the United States. These countries have been at the forefront of counterterrorism policymaking, having experienced significant terrorist threats that have shaped their legislative responses. |
