Comparative Insights into Witness Protection: Evaluating India's Framework Alongside Developed Nations

Abstract | The essence of delivering justice to the victim in the criminal justice system stands firmly on the base of the witnesses. It is essential for any act of crime to be purported with the help of a primary witness that would make it easier for the authorities to entangle the case more swiftly. However, it is very unfortunate to observe that even 77 years after Independence and 75 years of becoming a republic, our country still lacks a concrete statute for the for-witness protection. The witnesses in our country are more likely to become hostile, making their testimonies questionable due to oppression faced by them from the prosecution. This paper covers the track of witness protection in India and reflects the regime of witness protection in countries like the United States of America, United Kingdom, Canada as well as Canada. It shows how the subject of witness protection has been instituted into various pre-existing statutes rather than establishing a separate statute of its own in India. |
