Balancing Urban Growth and Environmental Law: Legal Obligations in Mumbai’s Construction Sector

Abstract The real estate and construction industry in India, especially in highly urbanized regions like Mumbai, has witnessed exponential growth driven by economic development and population expansion. However, this progress often comes at the cost of environmental sustainability. This article critically examines the environmental obligations imposed by Indian legislation on the building construction sector in Mumbai, focusing on the effectiveness of these legal frameworks and identifying enforcement challenges. Drawing on the doctoral research of author, the study evaluates how legal mandates, judicial interventions, and policy developments have influenced sustainable urbanization in Mumbai. Through the lens of key statutes, landmark judgments, and institutional practices, the paper argues for a harmonized legal approach to ensure responsible urban growth without compromising environmental integrity.
