Concept and forms of punishment with special emphasis on solitary confinement and capital punishment

Abstract Laws and Legislation are created and enacted to maintain a flawless and peaceful society. But sometimes, it has been violated and more crimes are occurring as a result of it the peace and harmonies of society have been disturbed. In order to bring orderly behaviour and to make the individual binding towards the law, punishments would be imposed on those who violate it. This theory or the concept of punishment can be traced back right from the ancient Vedic period. These punishments would be awarded based on the intensity of the crime which they have committed and there would be a clear mention or description of punishment for the crimes but now the laws are enacted to describe the punishment for the crime committed in a codified manner. Earlier, in the Vedic period, punishments would be imposed which is mentioned in Vedas and other legal textbooks which were prevalent in the Vedic period. The main context of this paper is to educate the readers with regard to punishments that were prevalent in the Vedic period and their application in the current period. It further specifies theories of punishment and their application to the present and a comparative study would be provided with regard to changes in society that might occur due to the implementation of strict and lighter punishments. A special focus would be addressed on solitary confinement and capital punishment like whether it was there during the Vedic period; and whether it violates the human rights principle all these things would be elaborated in the paper. Final emphasis would be given on providing suggestions for the drawbacks present in the existing punishments and whether any other punishment is necessary to be implemented in order to make the society run smoothly.
