The Invisible Trade: Exploring Organ Trafficking within the Framework of Human Trafficking in India.

Abstract | Despite legal bans, organ trafficking remains a hidden yet vital kind of human trafficking in India. This research investigates the intersections of organ trafficking and larger human trafficking frameworks, focusing on legal, socioeconomic, and institutional factors. The Transplantation of Human Organs Act (THOA) of 1994 was intended to govern organ transplantation, but its implementation has been plagued by corruption and loopholes, allowing commercial organ trading to thrive. Socio-economic vulnerabilities, such as poverty and a lack of awareness, exacerbate the situation. The study criticizes the current legislative framework, emphasizing inadequacies in enforcement and coordination between state and federal governments. It also looks at how non-governmental organizations (NGOs) might help with prevention, rescue, and rehabilitation. Drawing on case studies and legislative analysis, the paper argues for a rights-based approach integrating stricter legal reforms, victim-centric rehabilitation, and international cooperation to combat organ trafficking effectively. Finally, it emphasizes the necessity for a comprehensive strategy tackling poverty, corruption, and institutional reform in order to destroy this "invisible trade." By situating organ trafficking within the larger discourse of human trafficking, this study hopes to increase awareness and push for comprehensive policy changes in India to protect vulnerable populations and preserve human rights. |
