Abstract | The Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act) is a special statute enacted to control and regulate operations relating to narcotic drugs and psychotropic substances in India. It prescribes stringent provisions, especially regarding bail. This research paper explores the legal framework governing bail under the NDPS Act, analyzes the interpretation of these provisions by Indian courts, and examines whether the existing bail jurisprudence balances individual liberty and the need to control drug trafficking. |
