Abstract | The Transfer of Property Act, 1882, is a cornerstone of Indian property law, governing the transfer of property between living persons. While it is uniformly applicable across most Indian states, its implementation in Punjab has been subject to unique historical, legal, and administrative nuances. This paper explores the extent and manner in which the TPA is applicable in Punjab, with a focus on legislative exceptions, customary practices, and judicial interpretations. The study aims to provide clarity on the current legal position and highlight areas requiring harmonization for greater legal certainty in property transactions within Punjab. |
