Maintenance of Wife Under Muslim Law: Problems and Solutions

Abstract In India, the Muslim community constitutes the largest religious minority. Despite of the significant legal developments, many Muslim women remain unaware of their rights under Muslim Personal Law, especially in respect of maintenance. This paper explores the legal framework governing maintenance for Muslim women, with reference to the Quranic provisions, traditional Islamic jurisprudence, and landmark judicial decisions, particularly the Shah Bano case. The study highlights the relationship between religious doctrines and statutory law, emphasizing the need for greater awareness and legal clarity to protect the rights of Muslim women. By examining both historical foundations and contemporary interpretations, the paper aims to provide a comprehensive understanding of the concept of maintenance (nafaqah) under Muslim law in India.
