Protection of Consumers in Indian Jurisprudence - An Analytical Study

Abstract Protection to the consumers would be, in reality, the remedies provided to them on violation of any rights conferred. Consumers' rights are identified and thus provided under consumer protection law. In line with statutory rights, consumer rights are aimed at protection by providing appropriate remedies to consumers. Rendering remedies to the Consumer harm and injury is the main objective behind the consumer protection law. However, the nature of consumer remedies originated from the common law; the remedies to suit the rights provided under the statutory law would be the principle of Indian Jurisprudence. Therefore, the national legislation for consumer protection would achieve its goal and objective by providing remedies to consumers in the case of infringement of their rights provided under it. It is significant here to analyze provisions of consumer protection law in line with rights, their violation, and remedies provided by it. Therefore, consumer harms and consumer injuries need to be focused on first in order to ascertain the remedies to be provided against them. With this objective as the background, this article will focus on the analysis of the rights of consumers and their remedies under the consumer protection law.
