Judicial Activism and Buyer Confidence under RERA

| Abstract | Abstract The Real Estate (Regulation and Development) Act, 2016 (RERA) represents a paradigmatic shift in India's real estate regulatory framework, aimed at protecting homebuyers' interests and ensuring transparency in real estate transactions. This paper examines the role of judicial activism in interpreting and enforcing RERA provisions, and its consequent impact on buyer confidence in the Indian real estate market. Through an analysis of landmark judicial decisions, statutory provisions, and empirical data, this study demonstrates how proactive judicial interpretation has strengthened RERA's efficacy while simultaneously bolstering consumer confidence. The paper argues that judicial activism has been instrumental in filling legislative gaps, ensuring strict compliance with RERA mandates, and creating a more secure investment environment for homebuyers. The research concludes that continued judicial vigilance is essential for maintaining the Act's transformative potential and sustaining buyer confidence in India's evolving real estate landscape. |
