Intellectual Property Management through AI: Analysing Governance by Algorithms

Abstract Intellectual Property in the contemporary world of corporate has emerged as a crucial intangible asset, serving the purpose of providing a competitive upper-hand, highlighting innovation in growth. In addition, the simultaneous dawn of artificial intelligence brings about unprecedented prospects to transfigure IP governance, bringing about proficiency in areas involving analysis, strategies, detection of legal contraventions, portfolio-optimisation, etc. It may, however, not be overlooked that the said convergence has led to profound legal and ethical challenges, especially in India, wherein IP yet still a legally evolving area, in terms of regulatory frameworks, and the implementation of it thereof.

The present research critically analyses the integration of artificial intelligence into intellectual property in the context of national corporations, observing contemporary legal and structural frameworks, which is inclusive of the Companies Act, 2013, as well as other IP regulations, and the emerging legislations and rules. The paper analyses the practical implementations of artificial intelligence in the management of patents, copyright, trademark, at the same time assessing the increased accountabilities of Boards in their role of supervising “algorithmic transparency” and compliance of legal principles.

Through a set of strategic and tactical suggestions, such as enhanced capacity of the board, vigorous AI regulations, and proactive compatibility with accepted universal practices, the paper underlines the requirement for a more composed approach which embraces and sustains technological advantages, reinforcing corporate accountability and stakeholder trust. Ultimately, the paper argues towards reinforcing accountability in AI-enabled intellectual property governance, which includes within its ambit not only technological imperatives, but also tactful and ethical commitment crucial to long-lasting resilience, as well as accountability of Indian corporations.
