International Frameworks on Traditional Knowledge: Role of WIPO, TRIPS, and CBD

Abstract The protection of Traditional Knowledge (TK) is a pressing challenge at the intersection of intellectual property, biodiversity, and human rights. This article examines the roles, limitations, and evolving interactions of the three principal international frameworks—WIPO, TRIPS, and the Convention on Biological Diversity (CBD)—in addressing misappropriation, benefit sharing, and legal recognition of TK. It critically analyses the recent adoption of the WIPO Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge (GRATK, 2024), the unresolved debates over mandatory disclosure of origin under TRIPS, and the normative and implementation frameworks of the CBD/Nagoya Protocol. The article argues that these frameworks remain fragmented, but emerging institutional convergence and treaty innovations offer a path toward a more coherent sui generis international system for TK protection. The piece concludes with policy recommendations for integrating obligations, strengthening enforcement, and centering community rights.
