| Abstract | In an era where digital technologies mediate almost every aspect of human life, cybersecurity has transcended the realm of technical regulation to become a matter of fundamental rights and freedoms. The exponential rise in cyber threats—ransomware, surveillance, data breaches, and state-sponsored cyberattacks—poses direct risks not only to infrastructure but to human dignity, privacy, and freedom of expression. This article explores the evolving recognition of cybersecurity as a human right in international law. It analyses the normative foundations under the United Nations Charter, the Universal Declaration of Human Rights (UDHR), the International Covenant on Civil and Political Rights (ICCPR), and the General Assembly’s resolutions on “The Right to Privacy in the Digital Age.” Drawing from emerging jurisprudence of the European Court of Human Rights (ECHR), the UN Human Rights Council, and state practice, this paper argues that cybersecurity is no longer merely a matter of state security but a prerequisite for the enjoyment of civil, political, and socio-economic rights. The article concludes by advocating for the inclusion of cybersecurity in the corpus of human rights law as an essential, universal, and enforceable right. |
