The Role of Technology in Witness Protection: A Study of Video Conferencing and Digital Evidence in India

| Abstract | The application of technology has been identified as a significant element in the protection of witnesses in the changing face of criminal justice system in India where they are usually exposed to great dangers throughout the course of legal proceedings. In this paper we will be discussing the transformative role of video conferencing and digital evidence in witness protection and with the recently implemented Bharatiya Nyaya Sanhita (BNS), 2023, Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, and Bharatiya Sakshya Adhiniyam (BSA), 2023. According to these laws, there was a paradigm shift in the law of the colonial period where the use of digital innovations has been incorporated to cover the gaps that prevailed in the traditional courtroom systems. Video conferencing, which is provided under the BNSS Section 530, provides the ability to take remote testimony, reducing risks of physical exposure to threats and ensuring procedural fairness. Also, increased coverage of electronic documents under the BSA in Sections 2(d), 61 and 63 give digital artifacts, including CCTV footage, email communications, and server logs, primary evidence, which enhances the believability of the witness testimony in cyber-related, and organized offenses. |
