Whistleblower Protection and Corporate Accountability: Legal Challenges and Governance Reforms in India

Abstract Whistleblowing is becoming more important today as cases of fraud, corruption, and unethical behavior in companies and government bodies continue to rise. This study looks at how whistleblowers people who report wrongdoing play a key role in keeping organizations honest and accountable. It explains what whistleblowing means, the different types like reporting inside or outside the organization, and why it is needed to protect the public and ensure fairness. The study also explores the legal challenges whistleblowers face, especially when they are expected to keep secrets but feel the need to speak out for the greater good. By examining cases from both international and Indian courts, this study shows that the public's right to know the truth can be more important than keeping certain information confidential when serious misconduct is involved. In India, whistleblowing is supported by the Constitution, especially under Article 19(1)(a), which gives people the right to speak freely. Court rulings have said that exposing corruption should be protected and encouraged, not punished. This study argues that strong laws and systems must be in place to protect whistleblowers from threats or retaliation so they can safely report wrongdoing. This helps not only in preventing corruption and fraud but also in building trust, improving governance, and supporting the public good by making sure those in power are held responsible for their actions.
