Guarding the Temple of Justice: Political Intrusion, Judicial Independence and Assault on India's Chief Justice- Impact on the Judiciary's Democratic Role

| Abstract | Abstract Independence and Impartial Judiciary is the hallmark for s solid Democracy. Articles 13, 32, 50, 124(4) and 217(1)(b) of the Indian Constitution insulates this Judicial prerogative. But the latest attacks on Judiciary and the Political Jingoism raises many eyebrows. This research article explores the critical issue of political interference in the Indian judiciary through the lens of the physical attack on Chief Justice of India BR Gavai in 2025, a watershed moment in the judiciary’s struggle for independence amid rising political and ideological tensions. The article begins by situating the incident within the historical evolution of judicial independence in India, emphasizing constitutional provisions and landmark rulings that anchor the judiciary’s autonomous role. It then examines the contemporary political climate marked by increasing politicization of judicial institutions, highlighting how shifts in government attitudes and societal polarization contribute to vulnerabilities in judicial authority. A focused case study of the attack reveals the intersection of caste dynamics, ideological conflicts, and public distrust impacting the judiciary’s public standing. The article uses political science theories on institutional independence and democratic stability to contextualize the broader implications of political interference on democratic governance. Additionally, media discourse and public perception analysis demonstrate how narratives shape trust and legitimacy in judicial institutions. Addressing pressures from populist and majoritarian forces, the study discusses the judiciary's challenges in maintaining impartiality and upholding constitutional values. The article concludes by proposing institutional reforms to strengthen judicial autonomy, including increased transparency in judicial appointments, revisiting contempt laws, and promoting civic education on constitutional morality. Through this comprehensive examination, the research underscores the imperative of safeguarding judicial independence as a cornerstone of India’s democracy and the need to restore public confidence in its democratic institutions. |
