Mediation In Family Dispute: Balancing Emotional and Legal Interest

Abstract Mediation is a formal, voluntary Alternate Dispute Resolution (ADR) process where a neutral, unprejudiced mediator helps disputing parties negotiate and reach a mutually respectable agreement, avoiding a court assessed decision. The parties themselves retain control over the outcome, with the mediator easing communication relating issues and exploring options through private meetings and common sessions. Critical aspects of mediation neutral third party who’s prejudiced and has no stake in the outcome. Voluntary process participation is by a choice and the parties control the resolution. The mediation is private process where details are kept nonpublic. Negotiation grounded the focus is on parties reaching their own agreement through concession, rather than a decision being assessed by a judge. Facilities communication in the mediator helps parties understand each other’s perspectives and requirements. Pre-Litigation or litigation mediation can do before a case goes to court or indeed during the action process. Wide range of disputes including marketable disputes, intellectual property issues and family matters. Family disputes are sensitive forms of conflict as they involve personal relationship, emotions and future well-being of individuals particularly children. Traditional litigation often aggravates bitterness, prolonged conflict, and strains relationship further. Mediation has emerged as an effective Alternate Dispute Resolution (ADR) mechanism to resolve family conflict is more collaborative, confidential and non-binding. Mediation in family law matters typically covers: Matrimonial Dispute: Divorce, separation, restitution of conjugal rights. Child Custody and Guardianship: Determining visitation rights, parenting plans. Elder care issues: Disputes over caregiving responsibilities.
