Ensuring Justice: The Role of ICC under the POSH Act

Abstract As India is rapidly moving towards its developmental goals and women inclining more towards education and financial independence, the participation of women in the workplaces has also increased. However, with the larger influx of women in the mainstream workforce, sexual harassment at workplace also assumed greater dimensions. The unequal power dynamics in a hierarchical structure along with gender power dynamics of a patriarchal society, create an unequal footing for the women employees. The culture of silence that is conditioned into girls/ women, the fear of losing her job or similar consequences, and the unfortunate culture of victim shaming add to their grievance. Such incidents not only impact her- physically, mentally and emotionally but also have a direct bearing on the workplace productivity as well as the development of the society.
In order to curb these acts/ incidents of sexual harassment at the workplace, the Ministry of Women and Child Development, Government of India, enacted the first codified legislation specifically dealing with the issues of workplace sexual harassment, i.e. “The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013” (hereinafter referred to as the “POSH Act”), which came into effect on December 09, 2013. Subsequently, the government of India also notified the rules under the POSH Act titled “The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal Rules, 2013” (hereinafter referred to as the “POSH Rules”). The POSH Act along with POSH Rules collectively referred to as the “POSH Law”, aims to foster a safe and secure working environment for women by preventing, prohibiting, and redressing the instances of sexual harassment at workplaces in India.
