Reconciling Sustainability and Innovation: Analysing the Esg-ip Link in Corporate Governance

| Abstract | Corporate ethos of present world is shaped by the clarion call for sustainability and social justice whereby, the corporation stands at a juncture; either they could cling to the branches of profit driven paradigms or embrace a branch which is broader and towards a more enlightened stewardship of innovation. This paper aims to explore the integration of Environmental, Social and Governance principles (ESG) into the intellectual property governance, within the ambit of Indian corporate sector, which would offer a vision where intellectual property of a corporation would transcend its commercial components to become the instruments of collective upliftment. Through a study of India’s evolving legislative landscape, from SEBI’s Business Responsibility and Sustainability Report to the inclusion of Corporate Social Responsibility provisions in the Company’s Act, 2013; the paper also illustrates how regulatory mechanisms are nudging the corporations towards deeper accountability. Additionally, the paper interrogates the inherent tensions which exist between exclusivity and equitable access of the intellectual property, underlining the ethical and strategic dilemmas which are faced by the corporations and must be navigated by them. |
