Legal Challenges faced by women in NRI marriages: The need for effective financial and judicial support mechanisms in India.

Abstract Women married to Non-Resident Indians (NRIs) often encounter severe financial and legal hardships when deserted or neglected by their spouses abroad. Lacking financial means, legal awareness, and access to foreign judicial systems, these women are compelled to seek redress within the Indian legal framework. However, they face significant procedural and enforcement barriers, including delays in serving notices to husbands residing overseas and the absence of reciprocal enforcement agreements between India and several foreign nations. Moreover, India’s non-participation in international conventions governing maintenance obligations further complicates the execution of Indian court orders abroad. This paper examines the systemic challenges faced by women in NRI marriages, highlights the legal vacuum surrounding cross-border matrimonial disputes, and suggests policy measures and bilateral cooperation mechanisms to ensure effective financial protection and justice for affected
women.
