Cyber Extortion in India: A Critical Analysis of Legislation and Challenges

| Abstract | The rapid growth of digital technologies has led to an alarming increase in cyber extortion cases in India, posing significant threats to individuals, businesses, and government entities. This paper examines the legislative framework governing cyber extortion in India, with a focus on the Information Technology Act, 2000, and the Bharatiya Nyaya Sanhita (BNS). It analyzes the key provisions, punishments, and challenges associated with addressing cyber extortion in India. The paper highlights the complexities of enforcing cyber laws, particularly in cases involving jurisdictional issues and sophisticated cyber threats. It also discusses the initiatives taken by the Indian government to combat cybercrime, including the National Cyber Security Policy, 2023, and the Digital India Act. Through a critical analysis of case laws, legislative provisions, and expert opinions, this paper identifies the gaps in the current legal framework and suggests measures to strengthen India's cyber extortion laws. The findings of this research will contribute to the ongoing discourse on cyber security and inform policy-making efforts to combat cyber extortion in India. |
