"India's Legal Shift: Addressing AI Challenges with New Criminal and Data Protection Laws"

Abstract As India embraces the transformative potential of Artificial Intelligence (AI), its legal framework must evolve to address the complex challenges posed by these technologies. The Bharatiya Nyaya Sanhita, Bharatiya Sakhshya Adhiniyam, Bharatiya Nagrik Suraksha Sanhita and Digital Personal Data Protection Act , part of India's comprehensive legal reform initiative, collectively represent a forward-thinking approach to AI governance. The Bharatiya Nyaya Samhita addresses issues of accountability, privacy, bias prevention, cybersecurity, and the ethical use of AI, setting a precedent for integrating AI into India's criminal justice system. The Bharatiya Sakhshya Adhiniyam, or Indian Evidence Act, adapts to the era of AI by redefining standards for the admissibility, relevancy, and reliability of AI-generated evidence while emphasizing transparency and accountability. Meanwhile, the Bharatiya Nagrik Suraksha Sanhita focuses on national security and law enforcement, introducing provisions to regulate AI-driven technologies in these critical areas, ensuring they align with ethical standards and safeguard individual rights. Together, these acts provide a robust legal framework that not only addresses the immediate challenges of AI integration but also lays the foundation for India's leadership in AI governance on the global stage. This article highlights how these legal reforms collectively provide a robust framework to navigate the challenges of AI, positioning India as a leader in global AI governance.
