Statistical Analysis of Subject-wise Patents Granted in India

Abstract Intellectual property protection is gaining importance nowadays as people are recognizing that if they don’t protect their own intellect then it will be claimed to be of someone else. At the global level India have recognized its need to protect its intellectual properties which may be in varied forms like sculptures, literary work, traditional knowledge or innovative products, processes and trade secrets. Patents are that branch of intellectual property which deals with protection of such innovations which satisfy three conditions that is novelty, invention that has inventive step and should be commercially utilized for industrial application. This study aims at identifying the patent registration process which involves subject specific grant of patents. It is a quantitative study comprising of a comparative analysis of patents applied against the patents granted during respective financial years. It will help in analysing the improvements which are required to fast track the process so that the time gap will be reduced. The inventor should be aware of patent protection under the legal system of the country. It will help to find some suggestive measures to aware people about the different initiatives taken by Government of India to encourage the protection of intellectual properties from getting misused. The infringement and legal remedy for it should also be known to the public at large so that legal system can be sufficient enough to adhere to the cases and required amendments can be done as and when required by the laws. This study also highlights how India can improve at the global level in its strategies to safeguard its intellectual property.
