Role of First Information Report (FIR) in The Justice Delivery System

| Abstract | The First Information Report (FIR) is the base of the criminal justice process in India. FIR initiates the investigative process and it is the first step towards securing justice for victims of crime. It sets the law into motion by compelling police authorities to investigate cognizable offences. The FIR plays dual role: Firstly, it protects the rights of the victims by ensuring access to justice, on the other hand it also safeguards the accused by recording the earliest version of allegations. Despite its significance, FIR system in India has to face various challenges such as police refusal to register complaints, delay in filing FIR, and misuse though fake reporting. Methodology – The methodology adopted is Doctrinal, relying on statutory provisions, judicial decisions, and secondary sources such as Law Commission reports and academic writings. This Research paper examines the statutory framework of FIR under the Code of Criminal Procedure, 1973 (CrPC) and the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). It further explores judicial interpretations, including the Supreme Court’s mandate in Lalita kumari vs Government of Uttar Pradesh, and evaluates the FIR’s evidentiary value. This research paper argues that while the FIR is essential for justice delivery, systematic reforms and technological integration are needed to enhance its effectiveness. |
