Gender Justice in India and U.S.: A Comparative Study

| Abstract | Gender justice is a fundamental right of human beings which secures that women must obtain uniform protection and dignity before the eye of law. India’s post-reform criminal law infrastructure has worked on blocking gender-based offences, punishment, and amplifying the victim support mechanism like expansion of offences against women, harsher sentencing, and victim compensation schemes. However, still the societal boundaries and implementation holes create obstacles in the efficient delivery and execution of justice. The statutory infrastructure of the United States access gender justice in a distinct perspective in which federal and state-level laws are combined. To secure the rights of women Violence Against Women Act1(VAWA),1994 Title VII of the Civil Rights Act21964, and sexual harassment prevention regulations has reinforced significant multi-layered safeguards. Interpreted through a comparative approach, India has the potential to strengthen victim-focused policies, institutional answerability, and forceful mechanism, while the U.S. has the opportunity to strengthen its legal framework with the help of community-based solutions, integration of cultural sensitivity and ground-level awareness programmes. This paper comparatively analyses the gender protection mechanisms of the U.S. and India, emphasising on legal definitions of offences, procedural safeguards, victim support services, and enforcement methods. The aim and objective of the paper is to specify the weaknesses and strengths of jurisdictions, so that a hybrid model is proposed which prioritises the operational implementation along with the legal reforms. The conclusion of the paper provides best global blueprint Practices which is a step towards enacting gender justice as a universal standard. |
