The Abuse of Patent Pools in India

| Abstract | The patent pools are the agreement between the multiple patent holders, where they aggregate the patents and license them together. There are so many benefits in regard to the patent pools such as low transaction cost, reduced litigation in regard to the violation of patent rights and few more. This does not mean it may not have any criticism but there are few patent pools, lead to anti competitive nature, price fixing of the product in the market and have restrictive entry of the other companies or any other enterprises into the market. Many tech giants abuse the small and medium sized enterprises in the excuse of the patent pools in a way that the tech giants set their own terms and conditions in the favour of themselves as a dominant in the patent pool governance. Licensing terms can be considered as transparent and Opaque but the SME's, often considered to have get the small end of the rope as it may become more of a burden for them rather than the large companies. In some situations the large companies may often bundle essential and non essential patents together to make the small enterprises pay for the technologies they may not need them. So this research paper deals with how the tech giants abuse their power as a dominant in the patent pools and what are the challenges faced by the SME in this field and what are the enactments the countries have to solve this, what are Gaps in those and give recommendations regarding it. |
