Labour law awareness among hotel workers: rights, responsibilities, legal protections

| Abstract | The hospitality sector is a large employer in India which at the same time is very much a labor intensive one which means that we see a great many hotel workers in our cities and towns. But what we also see is that these workers are put in to very difficult situations which include issues like low wages, long working hours, unsafe environments, and sexual harassment. In this article we set out to give hotel employees a clear picture of what their rights and what their responsibilities are under Indian labor laws. We look at key pieces of legislation which include the Minimum Wages Act of 1948, Factories Act of 1948, Shops and Establishments Acts, and the Sexual Harassment of Women at Work Place (Prevention, Prohibition and Redressal) Act of 2013. Using case law and examples from the workplace, the article describes the protections afforded to employees and the responsibilities placed on employers. It discusses the conduct expected of employers, the protection of the workplace, the mechanisms available to employees for grievance redress, and the opportunities for professional advancement to be offered. By informing hotel employees of their legal rights, employees will be able to help maintain equitable, safe, and dignified workplaces and protect their rights. |
