A Legal Perspective on Human Rights Violations in Manual Scavenging in India.

| Abstract | Manual scavenging continues to be one of India's most humiliating practices, subjugating Dalit and marginalized communities to the task of drawing mortal waste, despite being legal proscriptions and indigenous safeguards. This practice, embedded in estate demarcation, undermines mortal quality and subjects workers to health hazards and social marginalization. This paper explores the literal, social, and legal confines of Manual scavenging, pressing significant legislation similar as the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act of 1993 and the Prohibition of Employment of Manual Scavengers and Their Rehabilitation Act of 2013, along with applicable judicial interventions. But still, lacking enforcement and societal apathy contribute to the ongoing frequency of this practice. A true end to manual scavenging necessitates further than just legal action it calls for social metamorphosis, technological advancements, and substantial recuperation sweats. Rescinding manual scavenging transcends sanitation; it's a moral and indigenous obligation to promote equivalency and save mortal quality. |
