From Consent to Confidentiality - An Ethical and Legal Analysis of Doctor Patient Relationship

| Abstract | As far as the doctor patient relation is concerned, the ethical foundation in their relationship is build upon the shared communication, individual autonomy, hope, trust which is governed by the legal and ethical standards to ensure that the patient’s autonomy towards choosing what is good for their health, to have a bodily autonomy and their own health. This paper highlights the ethical foundation of the doctor patient relationship and subsequently devolve into the historical evolution of the concept and practice of getting informed consent and to maintain the medical confidentiality. And further this paper attempts to establish the strong foundation of ethical and legal standards of the informed consent along with how this informed consent have been established in various countries like UK and US. This paper focus on the importance and legal standards on the medical confidentiality and lastly this paper discuss upon the therapeutic privilege that the medical practitioner has in their hands while treating the patients . |
