Militarization of Outer Space and International Law

Abstract The states are increasingly utilizing the outer space for a wide range of strategic and military purposes. The prevention of armes race in outer space is an important agenda for the UN disarmament and arms control. Under international law, the outer space has the status of global commons, i.e. “the province of all mankind”. However, its use is limited for the “peaceful purposes” that is “carried out for the benefit and in the interests of all countries”. The article examines the international legal framework governing the militarization of outer space, focusing on the Outer Space Treaty (OST) of 1967 and its interaction with the UN Charter. By analysing treaty law, state practice, and the Draft Treaty on the Prevention of the Placement of Weapons in Outer Space, this article aims at studying the international legal regime for the regulation of military activities in the outer space and seeks the explore whether available legal regime is sufficient to address the rising concerns of militarisation of outer space.
