Judicial Relief Without Official Accountability : Legal Cases Where Courts Provided Remedies to Victims but Government Officials Who Err Were Not Punished

Abstract In many legal systems, courts intervene to grant relief to victims of unlawful government actions, including compensation, injunctions, or declarations, yet the individual public officials responsible for the misconduct often escape personal punishment. This dichotomy between judicial relief and lack of individual accountability raises questions about the efficacy of legal remedies and the rule of law. This paper examines case law and legal doctrines that illustrate this phenomenon, with special reference to India and comparative principles from other jurisdictions.
