Protection of Afghan refugees in India: A Critical study

Abstract After prolonged third-party violence in Afghanistan and the Taliban’s reclaim of power in 2021, thousands of Afghan citizens have fled to India. Although India has a long-standing history of keeping refugee populations for decades, it is not a party to the 1951 Convention on refugees and lacks a specific local refugee statute. Afghan refugees are thus controlled by the general laws of immigration like the Foreigners Act, 1946, which creates legal uncertainty and arbitrary protection. This paper critically appraises the Indian refugee management regarding Afghan refugees, including the regulatory environment, provision of status determination by the United Nations High Commissioner to the refugees and socio-economic problems of refugees
