Effectiveness and Challenges of Alternative Dispute Resolution in Settling Agrarian Disputes: An Explanatory Sequential Mixed-Methods Study

| Abstract | This study aimed to determine the effectiveness and challenges of Alternative Dispute Resolution (ADR) in settling agrarian disputes in the second district of Negros Oriental. The researcher utilized an explanatory sequential mixed-methods design, integrating quantitative data from 207 DAR clients and qualitative interview findings. The researcher utilized validated questionnaires and employed Mean, Spearman’s Rank-Order Correlation and Kruskal-Wallis Test in treating the data. The study revealed that ADR is generally high level effective, particularly in terms of mediator competence, political will, and reduction of conflict recurrence. However, post-settlement monitoring was relatively lower, indicating gaps in follow-up and enforcement. While challenges were generally rated very low, qualitative findings revealed issues such as weak monitoring, non-compliance, power imbalances, and the influence of informal actors, which affect the sustainability of agreements. Correlation analysis confirmed that increased challenges significantly reduce ADR effectiveness. The study concludes that ADR is processually effective but structurally constrained. Strengthening monitoring systems, enforcement mechanisms, and institutional support is essential to ensure the long-term success of mediated settlements. |
