Custodial Violence in India: a Major Human Rights Threat

Abstract With the advent of time, Custodial violence is increasing in a blatant manner. Custodial Violence is an outburst against humanity and is one of the many root obstacles in a Democratic country. One of the biggest issues with custodial violence is that it has put human rights at stake. This is the worst form of human rights violation is a worldwide phenomenon that is inflicted upon individuals regardless of sex or age. This has become a very serious and alarming problem in third world countries like India. This article tries to analyse various provisions under the constitution of India providing basic fundamental rights to every individual in custody. This article also analyses various guidelines provided by the courts and award of compensation to the victim as an important methodology even though the constitution of India does not expressly provide for the right of compensation unlike other legal system.
The researcher in this Article aims to give a critical analysis on custodial violence. In this Paper the Researcher attempts to provide clarity on the Concept and meaning, types and forms, causes of custodial violence, detailed legal provisions which dealt with custodial violence and International Convention on Torture with a detailed analysis and interpretation of the Prevention of Torture Bill 2010 and 2017 and various landmark judgements given by Hon’ble Apex Court in order to curb custodial violence and provided some guidelines for the same. At Last, the researcher ended with conclusion and suggestions in order to achieve aims and objectives of various laws to curb custodial violence.
