Decoding Bhartiya Nyaya Sanhita, 2023 With Special Reference To Offences Against Women : An Analysis

Abstract This paper examines the framework of offenses against women under the Bharatiya Nyaya Sanhita, 2023 with an emphasis on its substantive provisions, procedural protections, and enforcement issues. In addition to evaluating the significance of evidentiary rules under the Bharatiya Sakshya Adhiniyam, 2023 and procedural safeguards under the Bharatiya Nagarik Suraksha Sanhita, 2023 , it critically examines important categories of offenses, such as sexual violence, domestic and matrimonial crimes, and trafficking. In addition to highlighting enduring systemic problems like underreporting, administrative inefficiencies, and sociocultural hurdles impeding successful implementation, the study delves deeper into important judicial interpretations. Additionally, it assesses how well the new legal framework addresses current issues of victim protection and gender justice. This paper concludes that although the legislative framework is primarily victim-centric and progressive, its efficacy depends on strong enforcement mechanisms.
