Legal and Practical Challenges In the Conduct of Video & Audio Recording of Interviews With Suspects In Tanzania

| Abstract | For quite long, there have been complaints towards the administration of criminal justice in Tanzania, particularly the mishandling of custodial interviews of criminal suspects by the Police Force in the course of criminal investigation. There have been allegations by the public about, among others, forced admissions and confessions through torture and other unacceptable means in the process of procuring cautioned statements from the suspects. In the move to provide control and openness of the process, on the 3rd of November 2023 the Chief Justice of Tanzania issued the Criminal Procedure (Video and Audio Recording of Interviews with Suspects) Rules of 2023, through Government Notice No. 792 of 2023. The Rules provide for the manner and procedure of holding interviews with suspects through video or audio recording. Despite the positive intention of issuing the Rules, there are legal and practical challenges in the application of the said Rules. This paper provides an analysis of the notable legal and practical challenges in the application of the Rules. It proceeds to make suggestions for necessary amendments for an effective and efficient control of interviews with suspects. |
