An Analytical Study of Juveniles in Conflict with Law in India: Evolution and Need of the Juvenile Justice System

Abstract Juvenile delinquency has emerged as a significant socio-legal concern in India, necessitating a comprehensive juvenile justice system that balances accountability with rehabilitation and child welfare. This paper examines the concept of juveniles in conflict with law by explaining the meaning of juvenile and juvenile delinquency, analysing the trends in offences committed by juveniles in India during the period 2013-2023, and exploring the need for a separate juvenile justice law. The study also traces the historical evolution of the juvenile justice system in India, covering the period before 1850, the colonial era (1850-1949), the post-independence period (1950-2013), and the legislative developments under the Juvenile Justice Acts of 1986, 2000, the 2006 amendment, and the Juvenile Justice (Care and Protection of Children) Act, 2015.
