The Evolution of Business Law in the Era of Globalization and Digital Transformation

Abstract Business law has undergone profound transformation in response to globalization, technological innovation, cross-border commerce, digital platforms, artificial intelligence, data-driven business models, electronic transactions, and the increasing complexity of multinational corporate activity. Traditional business law developed largely around domestic commerce, physical transactions, territorial jurisdiction, contractual relationships, company formation, property, taxation, and dispute resolution. In the contemporary economy, however, businesses operate through digital networks, global supply chains, cloud infrastructure, automated systems, electronic contracts, cross-border payments, online marketplaces, and platform ecosystems that frequently transcend national boundaries.
This paper examines the evolution of business law in the era of globalization and digital transformation through a doctrinal, conceptual, and systematic literature-review approach. It analyzes major changes in corporate law, contract law, competition law, consumer protection, intellectual property, data protection, cybersecurity, taxation, cross-border transactions, electronic commerce, dispute resolution, and corporate governance. Particular attention is given to the legal implications of artificial intelligence, digital platforms, algorithmic decision-making, electronic signatures, fintech, data governance, and transnational regulatory cooperation. The study argues that business law is shifting from a predominantly territorial and transaction-specific framework toward a more interconnected, technology-sensitive, risk-based, and compliance-oriented system. It concludes that modern business law must balance innovation, market efficiency, legal certainty, consumer protection, corporate accountability, and digital rights while strengthening international cooperation and regulatory adaptability.
