A Socio-legal Study on the Effectiveness of the Code on Wages, 2019

Abstract The Code on Wages, 2019 is a significant labour law reform aimed at consolidating and simplifying laws relating to wages, minimum wages, payment of wages, bonus, and equal remuneration. This socio-legal study examines the effectiveness of the Code in ensuring wage security, timely payment, fair wages, and equality among workers, with particular reference to cashew factories in Kollam District, Kerala.

The study analyses the legal provisions of the Code and examines their practical implementation through the experiences and awareness of workers, employers, trade unions, and labour authorities. Particular attention is given to minimum wages, regularity of wage payment, gender equality, working conditions, statutory compliance, grievance redressal, and labour inspection. The study also identifies the challenges faced in implementing the Code in the traditional cashew industry.

The research adopts a combination of doctrinal and empirical methods, including analysis of statutes, case laws, government materials, questionnaires, interviews, and field observations. The study seeks to determine whether the Code on Wages, 2019 has effectively strengthened wage protection and social justice among cashew workers and to identify measures for improving its implementation in Kollam District.
