| Abstract | India is often acknowledged as a ‘Welfare State’, a belief deeply rooted in the Directive Principles of State Policy outlined within the Indian Constitution’s Part IV, spanning Articles 36 to 51. These provisions incorporate the country’s dedication to the welfare of its people and the progress regarding the same. An essential inquiry that arises nowadays is if our legislative measures genuinely align with India’s ethos as a welfare-oriented nation? There are various laws attributing to the welfare legislations like : the Rights of Persons With Disabilities Act (2016), Rehabilitation Council of India Act (1992), and the National Trust Act (1999). This paper will focus on labour welfare legislations in particular. Instances of labour legislations includes the Factories Act of 1948, Employees Provident Funds Act of 1952, Industrial Disputes Act of 1947, Employee’s Compensation Act of 1923, Payment of Bonus Act of 1965, Payment of Wages Act of 1936, and Employees’ State Insurance Act of 1948. Specifically, this study zeroes in on the Industrial Disputes Act of 1947, a legislative measure designed to address and resolve industrial conflicts and serve the interests of workers as defined under section 2(s) of the Act. The primary objective is to conduct a comprehensive analysis of the practical impact of the Industrial Disputes Act on society. Through this thorough examination, we aim to unveil the true societal implications and the actual influence of this legislation purportedly aimed at welfare on our communities and labour force. |
