Right to Life with Reference to Pollution Free Environment

Abstract | The Right to Life, a foundational principle in national constitutions and international human rights law, has evolved to include the right to live in a clean, safe, and healthy environment. This extended interpretation recognizes that environmental degradation directly threatens human existence, health, and dignity. A pollution-free environment is no longer a mere policy aspiration but an essential component of the right to life itself. Judicial pronouncements, particularly in India, have affirmed that environmental protection is integral to safeguarding life and personal liberty under Article 21 of the Constitution. This paper explores the growing legal recognition of environmental rights as intrinsic to the right to life, emphasizing the urgent need for sustainable development, stringent environmental regulations, and state accountability to ensure that future generations inherit a liveable planet. The discussion underscores that a pollution-free environment is not a privilege but a fundamental right crucial for ensuring justice, equity, and human well-being. |
